For insolvency practitioners
The estate must be emptied. And accounted for.
Vehicles, machinery, stock, fixtures — and the long tail that no auction house will take in. We publish everything on the channels where each lot actually has buyers, and provide documentation that holds up when the trustee's report is examined.
The duty — and why how must be demonstrable
Swedish insolvency law does not compel a public auction as a general rule — the practitioner chooses the method of sale most advantageous to the estate. Precisely for that reason the burden of proof shifts to the practitioner's judgement: whoever chooses freely must also explain that choice, and a judgement is substantiated only by the documentation that existed when it was made.
”The trustee may sell movable property by continuing the debtor's business, at auction or in any other manner that the trustee considers most advantageous for the estate.” from Konkurslag (1987:672) 8 kap. 7 §
The same section also imposes a requirement for sales to related parties: where property is sold to the debtor or a related party, the sale must have been preceded by a public tender process, unless special reasons mean it is not required. The law does not specify what such a process must consist of — the practitioner decides the form, and must therefore also be able to show that it held.
The assignment as a whole is to safeguard the creditors' common right and interest (7 kap. 8 §). The review takes place in the trustee's report and in the final accounts (13 kap. 1 §), which are published and may be contested — and the fee is set by the court after a statement from the supervisory authority (the Swedish Enforcement Authority, 7 kap. 25 §). The claim ”you sold too cheaply” is not met by a receipt: the receipt shows the price, which is exactly what is being questioned. The only thing that meets it is that the property was widely offered and that the price was the best that came in — which is precisely what Budgiv documents.
How it works
- You send the inventory list. Or a brief description of what is to be disposed of.
- We divide it into sale lots — each item that warrants its own reserve price — and choose channels per lot.
- Publication on all chosen channels, over the same period.
- The bids are collected and time-stamped, channel by channel.
- You decide. The documentation is issued — a signed, hash-linked and qualified time-stamped Realisation Report that anyone can verify, without an account and without contacting us.
Frequently asked questions
Am I required to hold a public auction?
No — not as a general rule. The Bankruptcy Act allows the trustee to choose the method of sale freely (8 kap. 7 §). An exception applies to sales to related parties: where property is sold to the debtor or a related party, a public tender process is required, unless special reasons mean it is not needed. Even a trustee who chooses freely must be able to demonstrate that the choice was commercially sound — and that is precisely the documentation Budgiv delivers.
What does it cost?
One fee per sale lot, fixed before the first bid is placed and independent of the final price. It therefore never competes with the estate's distribution to creditors. See price per sale lot →
What happens to lots that do not sell?
The report still shows that the lot was offered on several independent channels for the stated period, without any bids coming in. That documentation cannot be obtained after the fact.
Does the documentation hold up when the trustee's report is examined?
Yes. The Realisation Report is signed, hash-linked and qualified time-stamped, and can be verified by the supervisory authority, a creditor or a court — without an account and without contacting us. Verify a report →
Do you take the entire estate, including the long tail?
Yes. We divide the estate into sale lots and choose a channel per lot — including items that no auction house will take in.
Ninety seconds, no account. Tell us briefly what is to be sold, and we will come back with a proposal for the choice of channels, how the assets are divided into sale lots, and a price.
